Because of these requirements, it is important for executors, administrators, and successor trustees to get competent advice from Realtors/Brokers that specialize in probate and trust sales.
FIRST RULE OF THUMB:
Work with a Broker who knows the complexities of the probate or trust transaction. Is it under IAEA, or does it need court confirmation? Is it a trust and has trust been properly executed and examined before house is put up for sale. Only an experienced Broker who specializes in these kinds of transactions, knows what to look for. SECOND RULE OF THUMB:
Work with a Broker who can help the Estate achieve its ultimate goal. Quick sale? Maximizing the valuation of the home in order to get the most out of the estate? Working with Realtor, who is well connected to tradespeople (painters, haulers, landscapers, estate liquidators) is important in helping you achieve your goals. Start to finish, we do it all!
THIRD RULE OF THUMB:
Knowing that the Broker who helps you is knowledgeble about exemptions under the probate and trust law. This is your best defense in shielding yourself in the Real Estate transaction. Probate and trust sales are exempt from the requirement to provide inspections, however there may be instances where it is good to provide them. We will go into the subtle nuances in a trust/probate sale.
